In accordance with the Act on the Right of Access to Information (»Official Gazette«, No. 25/2013, 85/2013) (hereinafter: the Act), the »Right of Access to Information« includes the right of users (any domestic or foreign natural or legal person) to request and obtain information, as well as the obligation of public authority bodies to provide access to the requested information, or to publish information regardless of a submitted request when such publication is required by the Act or other regulations.

Procedure for exercising the right of access to information and the right to reuse information

The right of access to information is exercised according to the manner and procedure prescribed by the Act.

Information and documents that are publicly available in electronic form may be accessed directly through the Faculty's website without submitting a special request.

Other information and documents are provided to the user who has submitted a request, either orally or in writing:

The response to an oral or written request for the right of access to information shall be forwarded within the legally prescribed deadline of 15 days from the date of submitting the request.

Fee for access to information and reuse of information

Users exercising the right of access to information are exempt from paying administrative fees.

Public Nature of Work

The University of Zagreb Faculty of Food Technology and Biotechnology ensures the public nature of its work, as defined by the Act on the Right of Access to Information (Narodne novine 25/13, 85/15, 69/22; hereinafter: the Act), by publishing information on the agenda and timing of Faculty Council sessions and by allowing the public to attend these sessions.

The University of Zagreb Faculty of Food Technology and Biotechnology is not obliged to allow direct public access to Faculty Council sessions when the law requires exclusion of the public, or when the information is subject to restrictions under the provisions of the Act.

At Faculty Council sessions open to the public under the Act, where the adoption of general acts affecting public interests is anticipated, a maximum of three (3) persons may attend simultaneously. If more citizens or representatives of legal entities apply, the Information Officer at the University of Zagreb Faculty of Food Technology and Biotechnology shall record the order of applications and, based on this order, grant permission to attend the session.

To apply to attend a Faculty Council session, applicants must submit a completed Request to Attend a Faculty Council Session to the Information Officer at the University of Zagreb Faculty of Food Technology and Biotechnology by email no later than three (3) days before the session.

Persons granted permission to attend a Faculty Council session may do so only upon presentation of an identification card. While observing the session, attendees may not participate in the discussion, ask questions, record the session, or disrupt the session (e.g., by talking or using a mobile phone).

Restrictions on the Right of Access to Information and Their Duration

In accordance with Article 15 of the Act:

The Faculty shall restrict access to information concerning all proceedings conducted by competent authorities during pre-investigation and investigation actions for the duration of those proceedings.

The Faculty may restrict access to information:

if the information is classified as secret, in accordance with the law governing data secrecy;
if the information constitutes a business or professional secret, in accordance with the law;
if the information constitutes a tax secret, in accordance with the law;
if the information is protected by the law governing personal data protection;
if the information is being drafted within a public authority, and its disclosure before completion could seriously impair the decision-making process;
if access to information is restricted under international treaties;
in other cases determined by law.

The Faculty may restrict access to information if there are grounds to suspect that its disclosure would:

prevent the effective, independent, and impartial conduct of judicial, administrative, or other legally regulated proceedings, or the execution of a court decision or sentence;
prevent the work of bodies performing administrative, inspection, or legality supervision;
violate intellectual property rights, except with the explicit written consent of the author or owner.

Information becomes available to the public once the reasons for restricting access cease to exist.
